Our experience includes researching complex litigation matters involving toxic torts,
CERCLA, RCRA, site remediation, federal and state cost recovery, potentially
responsible parties (PRPs), the Clean Air and Water Acts and most other environmental
and natural resource litigation issues. Additionally, we are skilled business litigation

Can you give me a specific example of a litigation research service you provide?
One of the most common types of litigation research efforts we manage involves
CERCLA/Superfund litigation. The Comprehensive, Environmental Response,
Compensation, and Liability Act (CERCLA), enacted on December 11, 1980, provided
the authority for federal authorities to respond directly to releases or potential releases of
hazardous substances that may endanger the public health or environment. One of the
provisions of CERCLA assigns liability of persons responsible for releases of hazardous
waste at sites. Those liable could include:
· the current owner or operator of the site (CERCLA section 107(a)(1));
· the owner or operator of a site at the time that disposal of a hazardous substance,
pollutant or contaminant occurred (CERCLA section 107(a)(2);
· a person who arranged for the disposal of a hazardous substance, pollutant or
contaminant at a site (CERCLA section 107(a)(3)); and
· a person who transported a hazardous substance, pollutant or contaminant to a
site; that transporter must have also selected that site for the disposal of the
hazardous substances, pollutants or contaminants (CERCLA section 107(a)(4)).
As such, we are often hired by companies or law firms to find information on the
historical operations and activities of Superfund sites, research whether there were other
"potentially responsible parties" who owned or operated the site, and/or if any
surrounding industry may have contributed to the contamination. Oftentimes, if there
were other "potentially responsible parties," we are hired to uncover any and all viable
corporate successors. Finally, we are often involved with cost allocation discussions at
these sites where each "responsible party" is assigned a dollar figure for the clean-up.
